A dog cannot say when it’s having a bad day, or whether its owner is mistreating it. Dogs, like people, can have serious mental issues, triggering disastrous consequences at times, absent proper care, training, and treatment. Dog Breed

No single breed of dog is particularly dangerous and the data is inconclusive. Our Pittsburgh dog bite lawyers have seen gruesome cases involving innocent seeming species, such as labs or poodles.  Some of the most severe cases we’ve handled over the past twenty-four years involved bites by “family dogs.” These are often generic mixes, and not necessarily pit bulls, German Shepherds, Rottweilers, or doberman pinschers.

Insurance Company Discrimination

When offering liability insurance, carriers in PA are precluded from denying or raising insurance rates for different breeds.  In Pennsylvania — and only 4 other states — it is illegal to charge more insurance premiums for, say, a pit bull versus a poodle.

Size of the Dog

Any size dog can be dangerous.  We handled one particularly unfortunate case where a young woman’s face was permanently and significantly scarred by a dog weighing less than 20 pounds.

The law in Pennsylvania reflects the above concepts, such that, in PA, by statute, any dog can be deemed “dangerous” or “viscous” based on its behavior.  Characterizing a pit bull as inherently dangerous would imply that other breeds are “safer,” which is totally untrue.  Every dog can become dangerous, and must be treated with respect and caution by its owners before anyone is injured.
